1. Introduction and Acceptance

These Terms of Service ("Terms") govern your access to and use of the website at hamptonshardmoneylenders.com and any services made available through it (collectively, the "Service"), operated by Lead Skills, LLC doing business as Hamptons Hard Money Lenders ("we," "us," or "our"). By accessing the Service, submitting an inquiry, or otherwise using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

2. Our Role: Lead Generation Service

We operate a lead-generation service that connects borrowers seeking hard money financing with one or more participating lenders who may be able to provide a loan. We do not make loans, extend credit, take loan applications, issue loan commitments, set rates or terms, or make any credit decisions. All credit decisions, including loan approval, interest rates, fees, terms, and funding timelines, are the sole responsibility of the participating lender that elects to evaluate your inquiry. A current list of participating lenders is available upon request.

3. No Offer or Solicitation

Nothing on the Service constitutes an offer, solicitation, or commitment to lend, an offer to extend credit, or a guarantee of any loan terms. Information presented on the Service is for informational purposes only. Submitting an inquiry does not guarantee that you will be matched with a lender, that any lender will respond, or that you will receive a loan offer or funding. Any loan offer is subject to the participating lender's independent underwriting and qualification criteria.

4. Eligibility

To use the Service, you represent that you:

• Are at least 18 years of age;
• Have the legal capacity to enter into a binding contract;
• Are submitting your own information, or are duly authorized to submit information on behalf of an entity you represent; and
• Will provide accurate, current, and complete information.

5. Your Consent to Be Contacted

By submitting your information through the Service and checking the consent box on our contact form, you provide your prior express written consent for one or more participating lenders to contact you at the phone number and email address you provided, including by autodialer, prerecorded or artificial voice, SMS or text message, and email, regarding your financing inquiry. You understand that your information will be shared with one or more participating lenders who may contact you. Consent is not a condition of receiving any services or obtaining a loan. Message and data rates may apply. Message frequency varies. You can opt out at any time by replying STOP to any text message or by calling 631-250-6794.

6. Equal Opportunity

We connect borrowers with lenders who are Equal Opportunity Lenders. Participating lenders do not discriminate on the basis of race, color, religion, national origin, sex, familial status, disability, marital status, or age.

7. Acceptable Use

When using the Service, you agree not to:

• Submit false, inaccurate, or misleading information;
• Submit information about a third party without their authorization;
• Interfere with or disrupt the Service or any networks connected to the Service;
• Attempt to gain unauthorized access to the Service or to other users' data;
• Use the Service for any unlawful, fraudulent, or abusive purpose;
• Use any automated means (bots, scrapers, etc.) to access or copy any portion of the Service.

8. Intellectual Property

All content on the Service — including text, graphics, logos, images, and software — is owned by Lead Skills, LLC or its licensors and is protected by U.S. and international copyright, trademark, and other intellectual-property laws. You may not reproduce, distribute, modify, publicly display, or create derivative works from any content on the Service without our prior written consent.

9. Third-Party Links and Services

The Service may contain links to or integrations with websites and services operated by third parties, including participating lenders. We do not control and are not responsible for the content, products, services, privacy practices, or terms of those third parties. Your interactions with any third party accessed through the Service are solely between you and that third party.

10. Disclaimers

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE, INCLUDING ANY WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE; THAT ANY DEFECTS WILL BE CORRECTED; OR THAT YOU WILL BE MATCHED WITH A LENDER OR RECEIVE ANY LOAN OFFER.

11. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT WILL LEAD SKILLS, LLC, ITS AFFILIATES, OR THEIR RESPECTIVE OFFICERS, DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL, ARISING OUT OF OR RELATING TO YOUR USE OF THE SERVICE OR ANY INTERACTION WITH A PARTICIPATING LENDER, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

12. Indemnification

You agree to indemnify, defend, and hold harmless Lead Skills, LLC, its affiliates, and their respective officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or related to (a) your use of the Service, (b) your breach of these Terms, (c) your violation of any law or the rights of any third party, or (d) any inaccuracy in the information you submit.

13. Governing Law

These Terms are governed by the laws of the State of New York, without regard to its conflict-of-laws principles. Any action arising under or relating to these Terms must be brought exclusively in the state or federal courts located in Suffolk County, New York, and you consent to the personal jurisdiction of those courts.

14. Changes to These Terms

We may modify these Terms at any time by posting an updated version on the Service. Changes are effective when posted. Your continued use of the Service after changes are posted constitutes your acceptance of the updated Terms.
